These Terms & Conditions govern the use of SecondHandBalloons.com, including browsing advertisements, creating an account, publishing advertisements and contacting other users.

By creating an account, submitting an advertisement or otherwise using the services provided by SecondHandBalloons.com, you agree to these Terms & Conditions.

1. Website Operator

In these Terms, “SecondHandBalloons.com”, “we”, “us” and “the platform” refer to the website and its operator.

2. Purpose of the Platform

SecondHandBalloons.com is an online classified advertising platform specialising in used hot-air balloons, balloon systems, components, equipment, accessories and related products.

The platform provides sellers with the ability to advertise equipment and allows interested buyers to contact sellers.

Unless explicitly stated otherwise, SecondHandBalloons.com:

• does not own the equipment advertised;

• does not act as the seller or buyer;

• does not negotiate transactions on behalf of users;

• does not process the purchase price between buyer and seller;

• does not take possession of equipment;

• does not arrange delivery or transport; and

• is not a party to contracts concluded between buyers and sellers.

Any purchase agreement is concluded directly between the buyer and seller.

3. User Accounts

An account is required to submit and manage advertisements.

Users must provide accurate and current information when creating and using an account.

Users are responsible for maintaining the confidentiality of their account credentials and for activity carried out through their account.

You must not create an account using another person’s identity or provide deliberately false or misleading information.

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently or present a risk to other users or the platform.

4. Private Sellers and Professional Sellers

SecondHandBalloons.com may be used by both private individuals and professional or commercial sellers.

Sellers must identify themselves as either a Private Seller or Professional Seller when creating their account and are responsible for ensuring that this status is accurate.

Professional sellers are responsible for complying with all legal obligations applicable to their business and transactions, including applicable consumer protection, product safety, tax, invoicing and other requirements.

The legal rights of a buyer may differ depending on whether equipment is purchased from a private seller or a professional seller.

Nothing in these Terms removes or limits mandatory consumer rights provided by applicable law.

5. Advertising Equipment

Sellers are responsible for the advertisements they submit.

Information supplied in an advertisement must, to the seller’s knowledge, be accurate and must not deliberately misrepresent the equipment, its ownership, condition, history, specifications or availability.

The seller must have the legal right to sell the equipment being advertised.

Advertisements should describe the actual equipment offered for sale. Photographs should, wherever reasonably possible, show the actual equipment.

Sellers must disclose known material defects or issues where omission could create a misleading impression about the equipment.

6. Multiple Items and Complete Systems

SecondHandBalloons.com allows certain advertisements to contain multiple individual items.

For example, a single Fuel Tanks advertisement may contain several tanks with different manufacturers, specifications, prices and availability.

The seller is responsible for ensuring that information associated with each individual item is accurate.

Individual items may be marked as Sold while other items within the same advertisement remain available.

Complete balloon advertisements may similarly contain information about individual components, such as envelopes, baskets, burners and fuel tanks.

The inclusion of components within one advertisement does not imply that SecondHandBalloons.com has verified that those components constitute a complete, compatible, certified or airworthy balloon system.

7. Prices

Prices shown in advertisements are supplied by sellers.

Unless expressly stated otherwise by the seller, prices should not be interpreted as including transport, customs duties, import charges, taxes, inspections or other transaction-related costs.

Where a listing contains multiple items, the seller may specify individual item prices and/or a price for the complete lot.

Buyers and sellers are responsible for agreeing on the final price and all associated transaction costs before completing a purchase.

8. Advertisement Review and Moderation

Advertisements may be reviewed before publication.

Review by SecondHandBalloons.com is intended primarily to maintain the relevance, usability and quality of the marketplace.

Approval or publication of an advertisement does not mean that SecondHandBalloons.com has verified or endorsed the seller, equipment, specifications, ownership, documentation, condition, safety or airworthiness of the advertised equipment.

We may reject, suspend, edit or remove advertisements that:

• violate these Terms;

• appear fraudulent or misleading;

• contain clearly inaccurate information;

• advertise prohibited or inappropriate products;

• infringe third-party rights;

• present a potential safety or legal concern;

• duplicate other advertisements excessively; or

• are otherwise unsuitable for the marketplace.

9. Aviation Equipment and Airworthiness

Hot-air balloons and their components are aviation equipment. Purchasing used aviation equipment requires appropriate technical and documentary due diligence.

SecondHandBalloons.com does not inspect, test, certify or determine the airworthiness or serviceability of equipment advertised on the platform.

SecondHandBalloons.com does not verify:

• maintenance history;

• logbooks or technical records;

• certificates or statements of conformity;

• registration information;

• serial numbers;

• component life limits;

• hours, flights or cycles;

• inspection status;

• repairs or modifications;

• applicable Airworthiness Directives or other mandatory requirements;

• compatibility between components; or

• compliance with aviation regulations in any particular jurisdiction.

Information appearing in an advertisement is provided by the seller.

Publication of an advertisement must not be interpreted as certification, approval, inspection or endorsement of the equipment by SecondHandBalloons.com.

10. Buyer’s Responsibility

Before purchasing aviation equipment, buyers are responsible for carrying out appropriate due diligence.

Depending on the equipment and intended use, this may include inspection by an appropriately qualified person and verification of:

• equipment identity and serial numbers;

• ownership;

• maintenance records;

• logbooks;

• certificates and documentation;

• hours, flights and cycles;

• component life limits;

• inspection status;

• repairs and modifications;

• regulatory compliance;

• airworthiness status; and

• suitability for the buyer’s intended operation and jurisdiction.

The buyer is responsible for determining whether equipment can legally and safely be placed into service.

11. Transactions Between Users

SecondHandBalloons.com provides the means for buyers and sellers to discover advertisements and establish contact.

Negotiation, inspection, payment, collection, shipping, import or export arrangements and transfer of ownership take place directly between the buyer and seller.

SecondHandBalloons.com does not hold or transfer the purchase price and does not guarantee completion of a transaction.

Users should exercise appropriate caution before transferring money or equipment.

For higher-value transactions, buyers and sellers should consider appropriate identity verification, written purchase agreements, secure payment methods and professional inspection of the equipment.

12. Contact Seller

The Contact Seller function allows a potential buyer to send an enquiry to a seller without publicly exposing the seller’s email address.

Messages submitted through this system may be processed by SecondHandBalloons.com for the purpose of forwarding the enquiry and maintaining the security and operation of the service.

Users must not use the messaging facility for spam, harassment, fraudulent offers, phishing or unrelated commercial solicitation.

13. Fraud and Suspicious Activity

Users should exercise particular caution with requests involving unusual payment arrangements, advance payments to unknown parties, unexpected third parties, changes of payment details or requests to communicate through suspicious channels.

SecondHandBalloons.com may suspend advertisements or accounts where fraud, misuse or unlawful activity is reasonably suspected.

Moderation and security measures cannot guarantee that every user, advertisement or communication is legitimate.

14. Prohibited Content and Conduct

Users must not advertise:

• stolen equipment;

• equipment they are not legally entitled to sell;

• deliberately misrepresented equipment;

• counterfeit documentation;

• unlawful goods;

• items whose sale would violate applicable sanctions or export restrictions; or

• unrelated goods or services outside the scope of the marketplace.

Users must not use the platform for fraudulent, deceptive, unlawful or abusive purposes.

15. Photographs and Other Content

Users retain responsibility for photographs, descriptions and other content they submit.

By submitting content, the user confirms that they have the necessary rights to use it.

The user grants SecondHandBalloons.com a non-exclusive right to display, reproduce, resize and technically process submitted content as necessary to operate and promote the marketplace and the relevant advertisement.

Users must not upload photographs, text or other material that infringes copyright, privacy or other third-party rights.

16. Sold and Inactive Advertisements

Sellers should mark equipment as Sold when it is no longer available.

Sold advertisements may remain accessible for informational purposes but may be removed from active marketplace search and category results.

Where an advertisement contains multiple items, individual items may be marked as Sold while other items remain available.

SecondHandBalloons.com may introduce advertisement expiry and renewal periods and may remove old, abandoned or inactive advertisements.

17. Availability of the Service

We aim to keep SecondHandBalloons.com available and functioning correctly but cannot guarantee uninterrupted or error-free availability.

The website may occasionally be unavailable because of maintenance, technical problems, security incidents or circumstances outside our reasonable control.

Features may be added, changed or discontinued as the marketplace develops.

18. Liability

SecondHandBalloons.com is an intermediary platform and is not responsible for performing the obligations of buyers or sellers under transactions concluded between them.

To the extent permitted by applicable law, SecondHandBalloons.com is not responsible for losses arising solely from:

Nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.

SecondHandBalloons.com is not responsible for the availability, content or practices of independent third-party websites or services.

Users should review the terms and privacy practices of third-party services separately.

20. Fees and Paid Services

Basic or additional marketplace services may be offered free of charge or for a fee.

If paid advertisements, promoted listings or other paid services are introduced, the applicable price and conditions will be shown before the user purchases the service.

The purchase of advertising or promotional services from SecondHandBalloons.com does not make SecondHandBalloons.com a party to the sale of equipment advertised by the user.

21. Suspension and Termination

We may suspend or terminate access to the platform where reasonably necessary because of:

• violation of these Terms;

• suspected fraud;

• illegal content or activity;

• security concerns;

• repeated misuse;

• attempts to interfere with the website; or

• other serious abuse of the service.

Nothing in these Terms deprives consumers of mandatory protections available to them under applicable law.

Disputes concerning the purchase or sale of advertised equipment should primarily be resolved directly between the buyer and seller, as SecondHandBalloons.com is not a party to their transaction.
